Workplace Safety Violations Cost Employers and a New York Injury Lawyer wants to protect worker's rights

A jury recently returned a $3.7 million verdict against the employer of a man who was seriously injured when he fell down an open elevator shaft. In New York, workers are routinely hurt and when they are injured should call a New York injury lawyer.

The worker (who, ironically, was responsible for safety at the construction site) fell because the rails intended to keep people from falling down the shaft had been partially disassembled. The evidence showed that one side of the rails had been unscrewed from the supports and, when the worker leaned on the rails, they gave way and he fell.
The fall caused the worker to break several ribs, his shoulder, and his elbow. His injuries were so serious that he could not move, and he had to be rescued from the elevator shaft by a crane.

At trial, the employer blamed the worker, saying that the worker had given permission for the rails to be loosened to allow another company to do some work. The employer also claimed that the rails were obviously not attached and that it was the worker’s fault for not noticing. However, these claims were undermined by another worker, who testified that the rails still looked as if they were properly attached. These kinds of cases are fact sensitive, says a New york injury lawyer and it's up to a jury to decide what the truth is.

OPRAH SUED AS AN AUDIENCE MEMBER SUFFERS AN INJURY....Crowd control is the responsibility of the show says a New York Injury Lawyer

Poor ole Oprah gets slapped with two lawsuits in the same week. One was filed by an audience member of the Oprah Winfrey Show who suffered an injury when the excited audience members stampeded into the auditorium to get their choice seats during a taping. The second was filed by a Boston mother who claims that she fed Harpo Studios the idea of Oprah’s new television show, Oprah’s Big Give, and has yet to get credit or compensation.

The first suit by the audience member was filed in Chicago’s Cook’s County Circuit Court (I dare you to say that 5x fast) by Orit Greenberg who is seeking at least $50,000 in medical fees and other damages because she says she has suffered “severe and permanent injuries.” Waaaaaaaaa! The suit blames Harpo for the incident, saying the company failed to exercise adequate crowd control measures and was careless to allow energetic women to battle it out out for the perfect seats. For the first case, a Harpo rep told E! News on Friday that the company does not comment on pending litigation. However, under New York Law a New York Injury Lawyer thinks there would be great merit to the claim if there was a serious injury. But for the second, a Harpo rep went on to say that Winfrey’s team was “confident that the Court of Appeals will agree that Tracy has no claim.

”Everyone’s a hater. I can handle Oprah in small doses, and I think she secretly regrets the Dr. Phil Frankenstein monster she created, she is doing good in the world and that is commendable. I invented 500 tv programs, I still am waiting for my royaly checks.

George Clooney's Motorcycle Crash Could Have Called for a New York Injury Lawyer

George Clooney and girlfriend Sarah Larson appeared at the premiere of Clooney's new movie, Michael Clayton. They had recently been involved in a serious motorcycle accident but showed up anyhow.
Larson, who broke her big toe in the crash, showed up on the red carpet on crutches and George, who fractured a rib, was no doubt in a lot of pain. Under New York State Law, Larson, a passenger on the motorcycle, could make a claim against Clooney as well as the other vehicle that was involved in the accident. However unlikely that might be. A good New York Personal Injury Attorney, will let you know your rights if you have been injured, so consult one if your in an accident.

Clooney said, with a smile, that he was in trouble because he's not supposed to be riding a motorcycle. He is currently shooting Burn After Reading with Brad Pitt. The films' producers had no comment.

He also talked to People magazine about the accident, saying: "I feel pretty lucky we got out of it. It's scary. We never really saw it coming."

What is Your New York Injury Case Worth? Call a New York Injury Lawyer and find out

When deciding whether to sue for an injury caused by another's carelessness, the first question people usually ask is "What is my case worth?" The answer depends on what kind of damages were caused by the other party's negligence.

Some damages that are recoverable are easy to see. If a negligent driver runs into your car and injures you, you can recover the cost of repairing or replacing your car and the cost of your medical bills related to the accident. You can also recover any lost wages because of time you missed from work due to your injuries.

Other kinds of damages are harder to see. If you have been hurt, you can usually recover something for the "pain and suffering" caused by the injury. You can also recover for things that are likely to happen in the future because of the injury you have suffered. That's why a New York Injury Lawyer can help you
